Upon motion of the defendant, and good cause appearing therefor, IT IS ORDERED granting Defendant Ben-Henry's Motion for Transportation Expenses

12 and Subsistence. 13

IT IS HEREBY ORDERED that the United States Marshal furnish funds for

14 transportation from Farmington, New Mexico to Phoenix, Arizona to attend Court on Tuesday, 15 November 22, 2005 at 9:00 a.m. 16

IT IS FURTHER ORDERED that the United States Marshal furnish the defendant with

17 an amount of money for subsistence expenses not to exceed the amount authorized as a per diem 18 allowance to travel under Title 5 U.S.C. §5702(a). 19

This order for transportation expenses and subsistence funds is entered pursuant to Title

20 18 U.S.C. § 4285. 21

IT IS FURTHER ORDERED that excludable delay under Title 18 U.S.C. § 3161(h) will 2 days.
