No substitution of counsel will be permitted. 16 Because this is a status conference, it will not be necessary for the Defendant(s) to appear in 17 person. 18 IT IS FURTHER ORDERED that five days prior to attending the status conference, 19 counsel must complete the following: 20 1. Meet personally and agree: 21 a. Whether the case will proceed to trial or be resolved by a plea. 22 b. Whether either party will seek a continuance. 23 c. What motions, if any, can be resolved by stipulation of counsel. 24 d. What disputed motions, if any, will be filed and need to be resolved. 25 e. Whether either party has filed or anticipates filing motions in limine. 26 2. File all 404(b) notices and LRCrim 16.1 notices. 27 3. Resolve any discovery disputes. 28

The topics listed in paragraphs 1-3 will be discussed and disputed issues resolved at the status conference. If a plea agreement has been submitted for the setting of a plea hearing or a Motion to Continue Trial has been granted by Wednesday, August 17, 2005 , the status hearing for that Defendant will be vacated. IT IS FURTHER ORDERED that, if at all possible, you shall e-mail, not telephone, the courtroom deputy at [email protected] or view this Court's calendar on the internet at www.azd.uscourts.gov to confirm that the status hearing has been vacated. ALL STIPULATED MOTIONS TO CONTINUE AND CHANGE OF PLEA DATE REQUESTS MUST BE RECEIVED BY AUGUST 17, 2005. The Order to Continue trial must include language vacating the status conference. If the Motion to Continue is not received by the above date, and a continuance is necessary, counsel must bring the motion to continue trial to the status conference or be prepared to be sanctioned. Counsel are further directed to contact the courtroom deputy by August 18, 2005 to advise how the case will proceed at the status hearing. No excludable delay shall result from entry of this Order.
