‘ Petition to Revoke Supervised Release
COMES NOW PROBATION OFFICER ASSISTANT Melissa A. Sullivan presenting an official
report on I\/Iargarito CURDINO+I\/IEDINA who was committed to the Bureau of Prisons on March 14,
2005, by the Honorable ii/lary H. li/lurguia presiding in the District Court of Arizona. A two year period of
supervised release was imposed, and supervision commenced upon the offender’s discharge from
imprisonment on November 16, 2006. In addition-to the general terms and conditions adopted by the
Court, the offender was ordered to comply with the following special conditions: `
1. if deported, you shall not re—enter the United States without legal authorization.
2. You shall cooperate in the collection of DNA as directed by the probation officer.
I\/largarito CURDINO-MEDINA was convicted of harboring illegal aliens, 8 USC §1324(a)(1)(A)(iii), a
Class C felony.
RESPECTFULLY PRESENTING PETITION FOR ACTION OF COURT FOR CAUSE
AS FOLLOWS:
Allegation A. Violation of Standard Condition No. 1: You s_haII not commit another federal, state
or local crime during the term of supervision. "
. On or about S.eptember 1 9, 2007, CURDlNO—l\/IEDINA committed the new federal offenses of attempted
re-entry after deportation and re-entry after deportation, Class C felonies. This is evidenced by a
complaint filed September 23, 2007, in the District of Arizona, Yuma, case no. 07-8839M. Court
proceedings are pending. Grade B Violation, §7B1.1(a)(2).
Allegation B. Violation of Special Condition No. 1:·If deported, you shall not re-enter the United
States without legal authorization. I
On or about September 19, 2007, CURDINO-MEDINA entered the United States withoutlegal
authorization. -This is evidenced by his September 19, 2007, arrest by Border Patrol Agents at or near
San Luis, Arizona. This arrest was subsequent to his November 16, 2006, deportation. Grade C
Violation, §7B1 .‘1(a}(3). ~
