15 WHEREAS, it has come to the attention of the Unite States government that an error in
16 the Presentencing Investigative Report existed; and,
17 WHEREAS, as a result of said error, the Sentencing Guideline total offense level should
18 and is l2 not 17 and,
19 WHEREAS, it is in the interests of justice to correct and amend the sentence imposed in
20 the above-captioned matter; and,
21 WHEREAS, the proper term of commitment would have been a guideline range of 12-1 8

5 THEREFORE, it is hereby stipulated by and between the parties, through their respective
6 attorneys of record, that, in accordance with Rule 35, that the sentence be corrected to reflect
7 a sentence of 12 months, and that the Defendant be ordered released forthwith.
8 IT IS ORDERED, that the Director of the Adult Institution, Department of Probation,
9 Work Furlough Center, 3511 Ocean View Boulevard, San Diego California, 92103, is to
10 forthwith immediately release the prisoner MANUEL A. GAMBOA, #8363 5-008 from custodial
1 1 confinement.
12 Excludable delay under 18 U.S.C. § 3161(h)_ is found to commence on
