The court has before it a letter dated March 24, 2008 (doc. 23) in which the defendant asks to be brought before the court in connection with the petition to revoke his supervised release (doc. 21). Also before the court is the response of the United States (doc. 24) and the defendant's reply (doc. 25). We are advised by the clerk that the probation department does not have a position on the request. The government's assertion that the United States is not required to pursue the petition while the defendant is in state custody in unrebutted. Accordingly, IT IS ORDERED DENYING the defendant's request to be brought before the court on the petition (doc. 23). This is without prejudice to the right of the defendant to seek legal advice from Ms. Alvarado, the lawyer appointed to represent him in this matter. DATED this 30th day of April, 2008.
