15 I, Sally A. Berg, declare under penalty of perjury that the following information
16 is true to the best of my information, knowledge, and belief:
17 1. I am employed by the Arizona Department of Corrections ("ADC") as a
18 Librarian III at the Arizona State Prison Complex ("ASPC")-Tucson. I am competent
19 to testify to the matters contained herein, and this Declaration is made of my personal
20 knowledge.
21 2. On August 11, 2005, Librarian Il Meade received a request for copies
22 from inmate Miller #109729. Due to the size of the request, the copies had to be
23 delivered to the Complex Librarian to be copied on the larger capacity copier.
24 3. I received inmate Miller’s request for copies from Librarian II Meade at
25 the close of business on August 11, 2005.
26 4. Inmate Miller’s request for copies was completed on August 15, 2005.

4 5. Because I was covering a unit on August 15, 2005, CEPT (Correctional V
5 Education Program Teacher) Smith hand delivered the copies to Deputy Warden 5
6 Martinez’s office for delivery to irunate Miller on that date. I
7 6. Contrary to inmate Mil1er’s assertions, at no time while making his
8 copies did I appropriate one of the exhibits. All the documents submitted by inmate I
9 Miller for copying were copied and retumed to him.
