18 tothe provisions of42 U.S.C. § 233 and 28 U.S.C. § 1346 and 2671 et seq., and by the virtue
19 of the authority vested in me by the Appendix II, 28 C.F.R. § 15.4, I hereby certify that 1 have
20 read the Amended Complaint in this action and all attachments thereto. On the basis of the
21 information now available with respect to the allegations contained in the Amended Complaint,
22 I find that at the time of the conduct alleged in the Amended Complaint the individual
23 defendants Dr. Luiz Rodriguez, Denise Williams, and Tracy Branch were all Public Health
24 Services Officers stationed at the Bureau of Immigration and Customs Enforcement, Medical
25 Unit, Florence, Arizona, acting within the scope of their employment as employees ofthe United
26 States at the time of the conduct alleged.
