ORDER
Defendants - Appellees.
Before: T. G. NELSON, SILVERMAN and BYBEE, Circuit Judges
A review of the record demonstrates that this court lacks jurisdiction orer
this appeal because the December l2, 2005 notice of appeal was not filed within
60 days from the order entered on September 15, 2005, denying plaintiff s motion
to reopen the case. See 28 U.S.C. § 2107; Alexander v. Sacha, 439 F.2d 742 (9th
Cir. 1971) (requirement of timely notice of appeal is jurisdictional).
Consequently, this appeal is dismissed for lack of jurisdiction.
