Plaintiff is preparing to file, pursuant to Federal Rule of Civil Procedure 59(e), a motion to alter or amend judgment regarding the Courts order granting Defendant Fleetwood Motor Homes of California summary judgment. Further, both Negatu Molla and David W. Williams, trial counsel for Workhorse Custom Chassis, will be out of the office the entire month of July preparing for and taking the Nevada Bar Exam, scheduled for July 25-27, 2006, and will be unavailable to respond to any filed motions in limine or confer on other pretrial issues that may arise in their absence. considering Plaintiff's motion and due to Workhorse's counsel's unavailability, the parties, Plaintiff Lane Sennett and Defendant Workhorse Custom Chassis, have agreed to amend the scheduling order. Therefore, the parties stipulate to and move to amend the scheduling order and have the Joint Pre-Trial Order due August 18, 2006. Further, the parties stipulate to and move to vacate the trial date and set the Final Pretrial Conference for October 30, 2006 and set a new trial date for November, 27, 2006.
