PLEASE TAKE NOTICE that, ursuant to Fed.R.Civ.P. 56. Defendant GTFM.

23 LLC ("GTFM"). moves this Court for an order granting summary judgment and dismissing all
2 4 claims against it in the consolidated actions entitled Meadowlark Lemon v. Harlem Globetrotters
25 International, Inc., et. al., CV O4-0299·PHX—DGC and Fred "Curly" Neal, et. al. v. Harlem
26 Globelrotters International, Inc., el. al., CV 04-1023-PHX-DGC. for the following reasons: (i)
27 Plaintiffs federal Lanham Act claims must be dismissed because there is no evidence of

1 secondary meaning or likely confusion; (ii) Plaintiffs are not entitled to recapture GTFM’s
2 profits under federal law or Arizona law; (iii) the claims against GTFM arc barred by laches: and
3 (iv) Plaintiffs have failed to establish "but for" causation.

The present motion is supported by GTFM`s Memorandum of Law in Support of its

6 Motion for Summary Judgment, the Statement of Specific Facts pursuant to Local Rule
7 1.10(l)(1). and the Declarations oflra S. Sacks and Bruce Weisfeld submitted herewith.
