15 PLEASE TAKE NOTICE that Defendants Harlem Globetrotters International, Inc. ("HGI"),
16 Harlem Globetrotters International Foundation, Inc. ("HGIF"), and Mannie & Catherine Jackson,
17 collectively "HGI Defendants," by their attorneys, move the Court for an order imposing sanctions
18 under Rule ll of the Federal Rules of Civil Procedure, and for the HGI defendants’ attomeys fees and
19 costs associated with the motion and Plaintiffs’ violations. This motion will be heard at a date and time
20 to be set by the Court.

This motion is brought on the following grounds:

l) Plaintiff Lemon lacks a factual and legal basis for alleging defamation against Defendant
23
24 HGI and Defendant Mannie Jackson, as contained in his Second Amended Complaint, Doc. 76.
25 2) Plaintiffs’ complaints improperly name HGIF and Mannie & Catherine Jackson.
26 3) Plaintiff Lemon’s Answer to Defendant HGI’s Counterclaim improperly includes a third-

1 party complaint against David Derrington, Ryann Baker, Meadowlark Lemon Harlem Allstars, Inc., and
2 Westwood Marketing, Inc. ("Derrington Defendants"). (Pl.’s Ans. to Counterclaim, 8/8/05, Doc. 144.)
3 Further grounds for this motion are stated in the HGI’s memorandum supporting motion for
4 sanctions and accompanying affidavits.
