"HGI Defendants," by their attorneys, move the Court for an order striking the affidavit of Edwin James Mutum pursuant to Fed. R. Civ. P. 37(c)(1). This motion will be heard at a date and time to be set by the Court. This motion is brought on the following grounds: 1) Plaintiff Lemon' Motion for Summary judgment relies on evidence s

presented in the affidavit of Edwin James Mutum. (Lemon SJ Mot., Doc 197, at 9-10.) 2) Fed. R. Civ. P. 26(a)(1)(A) requires each party to include among its initial

disclosures "the name and, if known, the address and telephone number of each individual likely to have discoverable information that the disclosing party may use to support its claims or defenses, unless solely for impeachment, identifying the subjects of the information." 3) Additionally, HGI Defendants' first interrogatories to Plaintiff Lemon,

authorized under Fed. R. Civ. P. 26(a)(5), requested that Lemon "[i]dentify all persons whom you believe have actual knowledge of any relevant facts pertaining to this case, and set forth a summary of the relevant facts you believe those persons possess." (Garvey Aff., 11/22/05, ¶ 2). 4) By order of this Court, the period for discovery ended on September 30,

2005. (Order, Doc 114, at 1). 5) Plaintiff Lemon at no time during or after the discovery period disclosed the

name of Edwin James Mutum, either as a person likely to have discoverable information under Fed. R. Civ. P. 26(a)(1)(A), or as a person with actual knowledge of relevant facts pertaining to this case in response to Defendants' interrogatory. (Garvey Aff., 11/22/05, ¶ 3.) 6) Pursuant to Fed. R. Civ. P. 37(c)(1), a party failing to disclose, without

substantial justification, information or witnesses required under 26(a) "is not, unless such failure is harmless, permitted to use as evidence at a trial, at a hearing, or on a motion any

witness or information not so disclosed." 7) The burden of establishing substantial justification and harmlessness is upon

the party who is claimed to have failed to make the required disclosure. Yeti by Molly, Ltd. v. Deckers Outdoor Corp., 259 F.3d 1101, 1107 (9th Cir. 2001); Green v. Baca, 226 F.R.D. 624, (C.D.Cal. 2005). 8) Plaintiff Lemon has presented no substantial justification for his failure to

disclose information regarding Mr. Mutum. 9) Plaintiff Lemon' failure to disclose the name of Edwin James Mutum, s

along with a summary of the relevant facts he is believed to possess, is not harmless, as Lemon relies on Mutum' affidavit to support his claim of a right of publicity. (Lemon SJ s Mot., Doc 197. at 9-10; Lemon SOF, Doc 206, ¶ 75.) In order to respond to Mr. Mutum' s claims, Defendant would be required to conduct additional fact-gathering and/or discovery before filing its response brief.
