I am counsel to James Todd Smith p/k/a LL Cool J, the plaintiff in the referenced action pending in NY Supreme Court (Justice B. Fried). Last week, I sent a request to have ULS copy and provide me with a certified copy of the "Affidavit of James Todd Smith In Support of Motion to Compel and In Opposition to Cross-Motion" dated November 14, 2005 (12 pages plus exhibits), which was filed in connection with a motion submitted to Justice Fried and argued on December 25, 2005. Justice Fried has not decided the motion and still has the case file. In the attached report, ULS advised yesterday that it could not get me the certified copy as it was not in the clerk's office. I just spoke with Justice Fried's clerk, Walter Mullen (646- 386-3310) and asked him whether I could send someone to retrieve the case file from Justice Fried so we could make a copy of the Smith Affidavit and get it certified. He said it would be no problem to do so. As this is a matter of urgency, I would ask that you, or someone from ULS, retrieve the case file from Justice Fried ASAP, make the copy of the Affidavit, have it certified by the clerk, and then provide me with the certified copy this week.
