Magistrate Anderson has scheduled mediation for September 28, 2006. By Order dated June 27, 2006 the Court set a final pretrial conference on August 30. By

Order dated July 10, 2006 the pretrial conference was continued to October 20, 2006 to accommodate settlement efforts. Motions in Limine and the Proposed Final Pretrial Order are due September 29. The inability to schedule mediation prior to September 28 requires a further extension of the pretrial conference to avoid the cost of preparing the Pretrial Order and Motions in Limine. All parties join in this request. The pretrial conference does not permit adequate time to conduct the September 28 settlement conference before the parties incur substantial attorneys' fees that would otherwise be available to fund a settlement of this case.
