As prescribed in the Court's Order dated July 24, 2006 (Dkt. 56), the last day to submit discovery request was August 4, 2006. Aros' second set of interrogatories to Defendants Rivas and Schriro is dated September 5, 206. Aros' discovery request is clearly out of time and in violation of the Court's Order. For the reasons set forth above, Defendants respectfully inform the Court that Defendants Rivas and Schriro will not respond to Aros' discovery request without further order of the Court.
