gg 1. I am an inmate in the custody ofthe Arizona Department of Corrections,
21 special Management Unit I, Florence, Arizona, inmate #145811, and
gg have personal knowledge of the matters set forth herein.
23 2. l am the Plaintiff in the above captioned proceeding.
2,1 3. On September 25, 2003, while being held at the Alhambra prison facility
25 in Phoenix, Arizona, I was assaulted by three other inmates.
25 4. On September 26, 2003, I was transferred from the Alhambra prieun

1 facility in Phoenix, Arizona, to the Arizona State Prison complex
2 ("ASPC"), Special Management Unit ll, ln Florence. Arizona.
3 5. On that same date, September 26, 2003, I was transferred to the ASPO,
4 Florence Central Medial Unit. l remained housed in the ASPC Florence
5 Central Medical Unit until October 3, 2003.
e 6. On October 0, EB03, l was transferred baolr to the ASPC Special
7 Management Unit ll in Florence.
gg B 7. On October 9, 2003, l was escorted from my cell by Correctional Otlicer
§ 9 (“OO"} III J. Moses, to an office within the ASPC Special Management
§ to Unit ll. CO IV D. Gaines was also in this office.
§g it B. While l was ln this oflice with CO lll Moses and OO IV Gaines, I asked
§ rg 12 CO IV Gaines for the appropriate forms to tile an Informal administrative
:§ S to grievance. The subject of my infcnnal grievance was going to be the
g E rg 14 assault I sustained on September 25. 2003, while being held at/Alhambra

ég 15 9. OO IV Gaines told me that I was out ofthe applicable time frames for
