Plaintiff, No. CV 04-0400 PHX PGR JOINT AGREED MOTION FOR EXTENSION OF TIME Defendant. Omron Corporation ("Omron") and Plaintiff Hypercom Corporation

("Hypercom") respectfully move this Court for leave to extend the deadline for filing their Joint Pretrial Statement, which is currently due on April 20, 2007, to April 25, 2007. In support of this Joint Agreed Motion for Extension of Time, the parties state: 1. Until recently, the pretrial conference in this matter was scheduled for

April 30, 2007 at 3:30 PM, and the parties' Joint Pretrial Statement was due on April 20, 2007. 2. On April 16, 2007, this Court re-scheduled the pretrial conference from

April 20 to May 14, 2007. The due date for the Joint Pretrial Statement remained unchanged. 3. The parties have been working to complete the Joint Pretrial Statement by

April 20, 2007; however, notwithstanding counsel's ongoing efforts to complete the Joint Pretrial Statement, counsel require additional time. Counsel believe that working on the document for three additional business days would result in a far more robust and useful final product. 4. Under the new proposed deadline, the Joint Pretrial Statement would be

due before the responses to the motions in limine are due, and more than two weeks before the pretrial conference scheduled for May 14, 2007.
