20 2. On September 11, 2003, Plaintiff sued Defendant in U.S. District Court, Eastem
21 District of Michigan. On May 17, 2004, Hon. George Careem Steeh, U.S. District Court
22 Judge of the Eastern District of Michigan severed Defendant from that action and
23
24 transferred the action against Defendant to this Court. The docket number in the Eastern
25 - District of Michigan is: 2:03cv73481-GCS. .
26 3. Defendant has not filed an answer or a motion for summary judgment.
27 4. This case is not a class action. _
