The Parties stipulate and agree that this lawsuit shall be dismissed with prejudice, with each side to bear their own attorneys' fees and costs incurred as a result of the matter. It is further stipulated that the Defendants will not re-file their Motion for Attorney's Fees and Costs before the United States District Court, District of Arizona, in Case No.: CV04-0408-PHX-SMM.
