18 I 1. I am over the age of 18 years. I am competent to state the facts and opinions
19 recited herein. If called upon to testify, I would give testimony consistent
20 with the facts and opinions stated herein.
21 2. I purchased a life size version of a sculpture entitled "Precious Cargo"
22 created by Jason Napier in August 2001. Atter purchasing the sculpture, I
23 donated it to the Town of Fountain Hills, Arizona for display in the
24 Fotmtain Hills Community Center Courtyard. The sculpture was delivered
25 I and installed outdoors in front ofthe Fountain Hills Community Center.
26 I 3. Jason Napier has his own recognizable style as a sculptor of wildlife. Jason
I 27 I Napier’s sculptures are highly stylized with sleek, smooth rounded lines and
28 I surfaces used to express an animal’s anatomy.

i I 4. It is Jason Napier’s style that caused me to purchase the life size “Precious
2 j Cargo" sculpture and not the speciiic pose of the mother mountain lion and
3 g baby mountain lion. I would not have hesitated to purchase a life size
4 i version of the mother mountain lion and baby mountain lion in another
5 different pose, or even a life size version of another animal.
