INTERIM RULE 16 SCHEDULING ORDER ON PENDING MOTION FOR CLASS CERTIFICATION

Pursuant to the terms of the Case Management Plan and the representations made by the parties at the Rule 16 Scheduling Conference, all parties shall comply with the deadlines established in this Order. A. The Federal Rules of Civil Procedure as amended and made effective

December 1, 2002 by the Supreme Court of the United States shall apply to all proceedings concerning this case. B. Defendants shall serve amended responses to Plaintiffs' Second Set of

Interrogatories and Second Set of Requests for Production of Documents within 60 days after the date of this Order and shall supplement their responses in accordance with the Federal Rules of Civil Procedure.

Defendants shall have until 90 days after the date of this order in which to

complete pre-certification discovery from putative class members represented by Martin & Bonnett. Such discovery may include document requests and interrogatories directed to all of the putative class members represented by Martin & Bonnet and up to 30 depositions of such putative class members. D. If a class is certified, the Court will revisit the issue of the timing and scope

of merits discovery from class members. E. Defendants shall file a supplemental brief in opposition to Plaintiffs' motion

for class certification within 120 days after the date of this Order. F. Plaintiffs shall file a combined reply to Defendants' initial brief and

supplemental brief in opposition to class certification within 150 days after the date of this Order. G. Oral argument on Plaintiffs' motion for class certification shall be held on

__________________, 2006 at _____ a.m./p.m.
