The undersigned counsel hereby move the Court to permit the filing of an oversize brief, not to exceed 31 pages, in Supplemental Opposition to Plaintiffs' Motion for Class Certification. Plaintiffs ask this Court to certify a class action comprising more than ten thousand former and current Honeywell employees in order to pursue various ERISA claims relating to employee retirement plans that have been in existence for more than 20 years. Plaintiffs' motion for class certification requires Defendants to address multiple legal and factual issues to demonstrate why the named plaintiffs are not appropriate class representatives and why class certification is otherwise not appropriate in this case. For these reasons, and in the interests of justice, Defendants respectfully request that this Motion be granted. DATED this 30th day of June, 2006. OSBORN MALEDON P.A.
