PLAINTIFFS' NOTICE OF FILING SECOND REVISED PROPOSED SCHEDULING ORDER

In accordance with the Court's Order dated October 4, 2006, (Doc. 242), Plaintiffs and Defendants filed a Proposed Scheduling Order on October 10, 2006 and on November 28, 2006, (Doc. 246), Plaintiffs a revised Proposed Scheduling Order modifying certain dates. In the Proposed Scheduling Order, the parties agreed that Plaintiffs would file a proposed notice to class members of the pendency of the class action lawsuit in accordance with Rule 23(c)(1)(B) of the Federal Rules of Civil

Procedure on December 1, 2006 and that Defendants shall submit a response to Plaintiffs' proposed notice on or before December 15, 2006. Plaintiffs served a draft of their proposed notice of pendency of class action on Defendants on November 28, 2006. Defendants have advised that they have comments on the proposed notice and the parties are in the process of arranging to confer on Plaintiffs' proposed notice. Accordingly, Plaintiffs are submitting this Second Revised Proposed Scheduling Order, attached hereto as Exhibit A, which adjusts the dates proposed by Plaintiffs with respect to the mailing of the notice of pendency of class action and makes a corresponding change in the date for Defendants' response. The revised dates herewith proposed by Plaintiffs continue to comply with the Court's directive that the Proposed Scheduling Order "will allow completion of this matter within one calendar year." (Doc. 242.) Defendants have advised Plaintiffs that they are not opposed to Plaintiffs filing their proposed Notice of Pendency of Class Action on December 8, 2006.
