1 documents and have deposed every pertinent witness involved in the case.
2 Additionally, the defendants have requested and have received a settlement
3 demand from the plaintiff. Both parties are in agreement that this case needs to go
4 before a magistrate to settle the case.
5 2. Status of Discovery:
ij The parties have tiled a stipulated request to extend discovery and
B dispositive motion deadlines. This extension request would ideally and potentially
9 result in a resolution of the case, which would save the parties and the Court time
10 and money.
44 3. Dispositive Motions not Filed:
12 The parties believe that the settlement conference will potentially result in
ij the resolution of the case, and dispositive motion would not need to filed.
15 4. Extension of Deadlines:
1 6 The parties have filed a Stipulated Request to Extend Discovery and
U Dispositive Motion Deadlines wherein the parties request that the Court modify
44 the deadlines in its September 22, 2004 and April 26, 2005 orders for filing
19 Dispositive motions and for conducting discovery. This motion is based on
ii unforeseen information that evolved from depositions taken in July, in which the
22 parties identified areas that additional discovery is needed in order to tile
23 successful Dispositive motions and/or resolve this case without further litigation.
24 The extension request would ideally and potentially result in resolution of the
25 case, saving the parties and the Court time and money. It was requested by the

1 parties that the Court grant the extension of discovery until November 30, 2005. It
2 is requested by the parties that the Court grant the extension of the deadline for
3 tiling Dispositive motions until December 30, 2005.

5 The parties request that this matter be referred to a Magistrate Judge for a

settlement conference to take place sometime October of 2005.
