Teilborg. Court Reporter: David German Appearances: Pro se plaintiff Albert W. DeLeon appears telephonically on his own behalf. Michael E. Gottfried for defendants. The Court is in receipt of [264] Defendant's Motion for Leave to file Summary Judgment and to Continue Trial. IT IS ORDERED denying [264] Defendant's Motion for Leave to file Summary Judgment and denying as moot Defendant's Motion to Continue Trial. On the Court's own motion, due to scheduling issues, IT IS ORDERED resetting trial from December 11, 2007 at Tuesday, January 29, 2008 at 9:00 a.m. in Phoenix, Arizona. IT IS ORDERED setting Status Conference for Wednesday, January 16, 2008 at 8:30 a.m. Defense counsel and plaintiff may appear telephonically for this status conference. Defense counsel is directed to make the necessary arrangements for plaintiff to appear telephonically and initiate a conference call to the court on 1/16/08. A jury panel of 8 persons shall be selected. Each side is permitted 3 preemptory strikes, strikes to be taken simultaneously. Defendant has advised the Court that defendants will prepare exhibits for trial and make party witnesses available for trial without need for the plaintiff to issue subpoenas. The only witness they have been unable to locate is witness Adrian Paradez. Plaintiff is advised that it is his responsibility to issue a subpoena for this witness with sufficient time and completeness to be served by the U.S. Marshals. Defendant's request for the court to reconsider its denial of defendant's request for leave to file summary judgment is denied.
