This Court entered judgment in favor of defendants on August 29, 2008. Defendants filed a motion for attorneys' fees on September 12, 2008. Their supporting memorandum is due on October 28, 2008, pursuant to Local Rule Civ. 54.2(b)(2). Plaintiff filed an appeal on September 12, 2008 (after the defendants filed their motion for fees). By the time that the defendants supporting memorandum is due, the case will be pending before the Ninth Circuit.
