Q Thank you for speaking with me on January 8, 2003. Per your advice, we have reviewed
Greece Y your correspondence of September 26, 2002 and December 9, 2002, along with all prior
ning Kong slut correspondence sent to Mr. Gifford’s attention. We have also contacted CNA regarding
Hmjsarr the status of Ms. Maynard’s claim and appeal for long—terrn disability benefits, their r
fggiqd review process, and their correspondence with you. .
Ital .
npia lt appears that on or about January 18, 2002, CNA provided you with a five—page final ,
Malirsii determination of benefits in which CNA advised that Ms. Maynard’s administrative
x“F‘°‘“S record was closed and the decision was final and binding. As you have been advised, r
Nxggms Hewitt Associates, as Plan Administrator, delegated the review and appeals processed to
phmppmes CNA. As such, it is I·Iewitt’s determination that all administrative review has been ·
P¤1¤-ad exhausted. Ms. Maynard may now pursue all remedies available at law including filing -
P°"“g*‘i_ suit in federal court. g

giigggjzm We also note from our review of CNA’s correspondence (except such correspondence .
Swrh Korea containing confidential medical information), CNA sent copies of the claim filed to your -
gpilg office at least twice, once on July 2, 2001 and again on February 28, 2002. According to
W? en CNA, the most recent copy forwarded to ou was voluminous based solel on the fact that Q

mm a please note that the majority of documents are CNA proprietary documents not available .
' to Hewitt, that several of those documents, including the policy, have been provided to -
you several times. Though you were advised by CNA in the July 2, 2001 correspondence g
to direct a request for the SPD to Hewitt, Hewitt has no such request on file other than the
one made in your December 9, 2002 letter. In any case, we enclose a copy for your file. 3 ·

We strongly disagree with your assertions that Ms. Maynard’s claim for benefits was
denied in bad faith or that the denial was retaliatory in any way. As previously stated
herein, and communicated by CNA on several occasions, Ms. Maynard has exhausted all
of her administrative remedies. She may now pursue any available remedies in court j
should she decide to do so.
Sincerely,
