1 The parties hereby stipulate and agree that the Court may vacate the presently-
2 scheduled September 26, 2005 pretrial conference in view of the pending Motion for
3 Summary Judgment, which has not yet been fully briefed. The parties also stipulate and I
4 agree that the pretrial conference should be rescheduled 45 days after the Court rules on
5 the pending dispositive mtion, or at such date as the Court finds convenient.
6 The parties acknowledge that pursuant to the Court’s Order filed May 3, 2005,
7 the parties have 30 days following the ruling on the present pending motion to file a I
8 pretrial order. The content of the proposed pretrial order shall include, but not be
9 limited to, that prescribed in a standard form of pretrial order which was given counsel
O 10 at the scheduling conference. t
