18 Jordan Green, being first duly swom, says:
19 l. I am one of the attomeys for Defendants Avnet, Inc., Roy Vallee, and Alan
2 0 Maag (the "Defendants”) and have personal knowledge of the matters set forth herein.
21 2. I exchanged several letters with Plaintiffs counsel regarding the lack of
22 disclosure of Mr. Sedlik’s opinions and Plaintiffs intended use of him as an expert at
23 trial.
24 3. In a March 14, 2006 letter, I requested that the parties meet and confer on
25 the issue. gee Exhibits G-L.
26 4. On March 27, 2006, Plaintiff responded to my request to meet and confer,

1 stating that such a meet and confer was "unnecessary and unwarranted." ge Exhibit M.
2 5. Upon receipt of Plaintiffs letter, I called the Court to arrange a joint
3 telephonic conference regarding the parties’ discovery disputes.
4 6. I spoke with the Court’s Judicial Assistant, who indicated that she would
5 contact me after speaking with the Court.
6 7. I received a retum phone call from the Court’s Judicial Assistant, who
7 advised me that the Court would not hear argument over any further discovery disputes
8 because discovery in this case had ended.
