The parties stipulate and agree that the deadline in this case for Plaintiff to respond

21 to Defendant Avnet's Motion for Amendment of Judgment or New Trial, Defendants Maag 22 and Vallee's Bill of Costs, and Defendants Maag and Vallee's Motion to Join Plaintiff's 23 Wife, Angela J. Simon, as a Necessary Party be extended until Friday, October 27, 2006 at 24 5:00 p.m., while the parties obtain final client approval and signatures on settlement 25 documents. The parties have verbally agreed on a settlement draft but need additional time 26 to obtain signatures on such settlement agreement. The parties have not reached any 27 unexpected problems with settlement, but simply need additional time to obtain signatures 28

on the documents, and today plan on filing a Notice of Settlement by October 27, 2006. A Proposed Form of Order is attached hereto.
