Plaintiffs respectfully lodge this objection to Defendant’s putative calculation of

damages for the Fernandez claim on the following grounds: 1

1. The Defendant requested permission to submit its damage calculation to the
26 ‘
Court. The Court did not authorize Defendant to provide calculations of S

1 2. Defendant’s calculations are erroneous. As to Exhibit "A", Defendant has
2 misstated the total LAE listed on Trial Exhibit 28. That figure should be i
3 $2,177,718.90. Further, Defendant neglected to factor the $100,000 Vela
4 Mante recovery and the $274,976 Veloz settlement into the total Femandez .
5 settlement. Both of these figures are corroborated by Trial Exhibit 28 and
6 the testimony of Mr. Matush, and were admitted by Defendant in the Joint 1
7 Pretrial Order (Factual Issue #42, #43) Use of the correct figures results in 1
8 a total balance due to Plaintiffs of $l,24l,925.54. .
9 3. As to Exhibit "B", Defendant offered no evidence that the Martinez
10 settlement and LAE did not exhaust the underlying policies. Mr. Matush
11 testified at his deposition that payments with respect to the Martinez claim
12 occurred prior to the Fernandez settlement. Matush Depo., p. 47 - 49, and A
13 Trial Exhibit 31 substantiates the indemnity and LAE payments in (
14 connection with the Martinez claim. In any event, Defendant did not raise
15 the putative lack of exhaustion of the underlying policies’ aggregate limits
16 as the result of the Martinez claim in the Joint Pretrial Order. Accordingly,
17 it should be precluded from raising the issue now. 1
