18 Defendant, Charles Schwab & Co., Inc. (“Schwab"), by and through its counsel
19 undersigned, respectfully moves this Court for a reasonable extension of the 17~page
20 limit set forth in Local Rule 7.2(e), which is otherwise applicable to its Motion for
2l Summary Judgment. This Motion is made pursuant to Rule 7.2(e), Local Rules of Civil 1
22 Procedure.
23 The deadline for filing dispositive motions in this case is Friday, March 31, 2006.
24 Schwab intends to file two motions for summary judgment, one addressing liability and
25 one addressing damages. Neither motion will exceed the l7—page limit imposed by Local
26 Rule 7.2(e). However, the pages of the two motions, when combined, will exceed the
27 page limit.

1 Schwab acknowledges that neither this court’s Scheduling Order nor the
2 applicable court rules limit a party to one motion for summary judgment. Nevertheless,
3 in an abundance of caution, Schwab is seeking permission to file two separate motions, i
4 which when combined may exceed the page limit by approximately nine pages.
5 lf granted, Schwab’s motion will dispose of the entire case. The requested
6 extension is needed in order to address all of the reasons why Schwab is entitled to
7 summary judgment on plaintiffs five-count complaint. Plaintiff alleges sexual -
8 harassment, sex discrimination, national origin discrimination, retaliation, and a violation
9 of the Civil Rights Act. The facts and law applicable to each of these counts is often
10 different, requiring additional briefing.
§ ll Moreover, Schwab believes that it is also entitled to summary judgment with
gt; 8 § 12 respect to damages. Plaintiff seeks backpay, frontpay, compensatory damages, damages

18 file, its Motion for Summary Judgment Re: Liability and Motion for Summary Judgment
19 Re: Damages, which together may exceed the page limitation by approximately nine
20 pages.
