NO. CV 04-0790 PHX-JWS EXPEDITED MOTION TO EXTEND RESPONSE DEADLINE TO MOTIONS FOR SUMMARY JUDGMENT (Second Request)

Plaintiff Marcela Johnson ("Johnson") respectfully requests an additional four days to respond to Defendant Charles Schwab Corporation's ("Schwab") Motions for Summary Judgment. The current response deadline is May 8, 2006. Johnson requested a stipulation from Schwab to extend the response deadline to May 12, 2006. Schwab refused to stipulate to the extension unless Johnson agreed to extend the Reply deadline by an additional eight days. The parties previously filed a stipulation to extend the original response deadline by one week, from May 1, 2006, to May 8, 2006, and the reply deadline almost two weeks, from May 19 to June 1, 2006. Johnson respectfully requests this Court to extend the Johnson's response deadline to Schwab's Motions for Summary Judgment an additional four days from May 8, 2006, to May 12, 2006. This request will not prejudice Schwab because it will still have three weeks to file the reply.
