PROCEEDINGS: ORDER FROM CHAMBERS October 17, 2005 _____________________________________________________________________ The court has considered the motion for reconsideration at docket 40. Plaintiff is correct that the court misapprehended the proposed order supplied by defendant, because the proposed order referred to the "parties' motion." This fact does not excuse the court's action, because the underlying motion is labeled clearly enough as a motion by defendant. The court is still adjusting to what on balance are the considerable advantages of ECF, but has now discovered the need to double-check what a party recites in a proposed order which simply shows up in an electronic mail box. All of that said, the court concludes that the relatively modest extension granted (a little more than 60 days) and the probability that one or both of the parties have relied to some extent on the new schedule persuades the court not to reconsider the order granting the extension. However, the court wishes to make clear that it has neither accepted nor rejected the arguments advanced by defendant in the motion at docket 37. For the above reasons, the motion at docket 40 is DENIED. ______________________
