Petition to Revoke Supervised Release I
COMES NOW PROBATION OFFICER ASSISTANT Melissa A. Sullivan presenting an official
report on Wayne Charles Bryan who was committed to the Bureau of Prisons on June 5, 2001, by the
Honorable James A. Teilborg presiding in the District Court of Arizona. A five year period of supervised
release was imposed, and supervision commenced upon the offender’s discharge from imprisonment
on April 23, 2004. In addition to the general terms and conditions adopted by th Court, the offender was
ordered to comply with the following special conditions:
1. You shall participate as instructed bythe probation officer in a program of substance abuse treatment
which may include testing for substance abuse. You shall contribute to the cost of treatment in an
amount to be determined by the probation officer.
2. lf deported, you shall not re-enter the United States without legal authorization.
3. You shall submit to search of person, property, vehicles, business, and redidence to be conducted
in a reasonable manner and at a reasonable time by, or at the direction of, thel probation officer.
I 4. You shall provide the probation officer access to any requested financial information.
5. You are prohibited from making major purchases, incuring new financial obligations, or entering into
any financial contracts without the prior approval of the probation officer. I
6. You are prohibited fromowning, maintaining or using a firearm.
Wayne Charles Bryan was convicted of conspiracy to possess with intent to distribute marijuana, 21 USC
§846, a Class A felony.
RESPECTFULLY PRESENTING PETITION FOR ACTION OF COURT FOR CAUSE
AS FOLLOWS:
Allegation A. Violation of Standard Condition No. 1: You shall not commit another federal, state
or local crime during the term of supervision.
On or about May 16, 2007, Bryan committed the new federal offense of re-et1try after deportation, a
violation of 8 USC §1326(a) & (b)(2), a Class C felony. This is evidenced tty Los Angeles County
Sheriff’s Department booking no. 9797332. Grade B Violation, §7B1.1(a)(2)l

Allegation B. Violation of Special Condition No. 1: lf deported, you shall not re-enter the United
States without legal authorization.
On or about May 16, 2007, Bryan entered the United States without legal authorization. This is
evidenced by his May 16, 2007, arrest by Los Angeles County Sheriff’s Deputies. This arrest was
subsequent to his July 15, 2004, deportation. Grade C Violation, §7B1.1(a)(3).
AFFIDAVIT AND PETITION PRAYING THAT THE COURT WILL ORDER A I/VARRANT BE ISSUED
In conformance with the provision of 28 U.S.C. § 1746, I declare, under penalty of perjury, that the
foregoing is true and correct to the best of my knowledge. Based on the information presented that the
offender has violated conditions of supervision, I am petitioning the Court to issue a warrant.
