Defendant filed a motion entitled "Motion for Change of Counsel" but what he really seeks within the motion is appointment of counsel for the purpose of challenging his commitment to the Bureau of Prisons arising out of the conviction he suffered in the District of Oregon in 1985 under case number CR85-95-02. Apparently, several months after sentencing in the above-entitled and numbered cause Defendant was arrested to serve whatever remains on his Oregon conviction. He seems to think that he can attack that custody in this case because of comments that may have been made at his sentencing concerning whether his sentence had expired in the Oregon conviction.

IT IS ORDERED denying the Motion for Change of Counsel. There are no proceeding pending in the above-entitled and numbered cause. Defendant's current custody status can only be addressed either before the Bureau of Prisons or before the Court in which he was convicted in 1985. (doc. 28). DATED this 29th day of November, 2006.
