Defendant is indigent and is financially unable to retain 23 counsel. Defendant had his initial appearance in Yuma, Arizona, before Magistrate 24 Judge Jay R. Irwin, on September 28, 2007, at which time Assistant Federal Public 25 26 27 28 Defender Lorna Spencer was appointed to represent Mr. Johnson. After this appointment, Defendant's case was transferred to Phoenix. Therefore, Assistant Federal Public Defender Lorna Spencer should be terminated as counsel in all further proceedings.
