The basis asserted by Plaintiffs for this Court's jurisdiction is 28 U.S.C. § 1331 and 5 U.S.C. §

22 § 701 - 706. The parties do not dispute that venue is proper in this district. No issues exist 23 regarding personal jurisdiction or venue, and no parties remain to be served. Defendants will 24 argue that the Complaint, with regards to Plaintiff Antonio Torres, is moot. 25 26 2. Facts: Plaintiff Rosalinda Torres and Edgar Antonio Torres each filed a Form I-485 application to

27 adjust their status to lawful permanent resident with the United States Citizenship and Immigration 28 Services (USCIS) on or about on June 15, 2004. The USCIS has not yet adjudicated the Form IJoint Case Management Statement C07-4827 SI 1

1 485 application for Plaintiff Rosalinda Torres, but completed the adjudication of Plaintiff Antonio 2 Torres in November 2007. The Plaintiffs filed an action on September 20, 2007, seeking an order 3 from this Court directing USCIS to adjudicate the Form I-485 applications. 4 5 3. Legal Issues: Whether this Court should dismiss Plaintiffs' action for lack of subject matter jurisdiction. If

6 this Court has jurisdiction, whether the USCIS is processing the Plaintiffs' I-485 applications 7 within a reasonable period of time. 8 9 10 11 12 13 14 15 4. Motions: The parties intend to file cross-motions for summary judgment. 5. Amendment of Pleadings: No parties, claims or defenses are expected to be added or dismissed. 6.
