Winter, Secretary of the Navy, filed a motion to dismiss and noticed the motion for a hearing on February 15, 2008. The Court HEREBY ORDERS that Plaintiff's opposition to the motion shall be due on January 10, 2008, and Defendant's reply shall be due on January 17, 2008. If the Court finds the matter suitable for disposition without oral argument, it shall notify the parties in advance of the noticed hearing date.
