February 16, 2005 in the action captioned F crrirzg B. ld and Aventis Pharmaceuticals Inc.
v. BarrLabo1‘a!orfes Inc., Case No. 02 CV 9851, and the l\/Iemorandum and Order issued
on February 7, 2005 upon which the Judgment is based. On February 23, 2005 plaintiffs
tiled their Notice of Appeal to the Court of Appeals for the Federal Circuit. A proposed
Order is attached hereto as Exhibit A.
