WHEREAS, the parties are earnestly engaged in good faith discussions concerning a settlement of

20 this action and the underlying dispute; 21
WHEREAS, the parties and their respective counsel requested and received from the Court on June

22 23, 2008 a stay of proceedings in this action of at least sixty (60) days to allow them to focus on their 23 settlement discussions; 24
AND WHEREAS, the Court ordered the parties to report to the Court the status of their discussions

25 after thirty days; 26
NOW THEREFORE, the parties, through their respective counsel of record, report that settlement

27 discussions are on-going, and that these discussions, if consummated, will resolve all issues in the instant 28
