PLAINTIFF Adobe Systems Incorporated ("Adobe" or "Plaintiff") by and through its counsel of record, J. Andrew Coombs, of J. Andrew Coombs, A P.C., hereby requests as follows: WHEREAS the Court set the Scheduling Conference in the above-captioned matter on June 30, 2008, at 10:00 a.m.; WHEREAS Defendant has not been properly served; WHEREAS Defendant's father received notice of the lawsuit and contacted Plaintiff but refused to provide information to locate Defendant; WHEREAS Plaintiff is currently preparing an ex parte application for expedited discovery to be filed with the court within the next two weeks; WHEREAS there have been no prior continuances requested by the Parties; and
