Rule 4 ofthe Federal Rules of Civil Procedure requires certain parties to cooperate in sax me
unnecessary cost ofservice ofthe summons and the complaint. A defendant located in thc
United States. who, al`ter being notified of an action and asked to waive service ofsuininons
on hehalfof a plaintiff located in the US, fails to do so will he required to hear tl1c cost of
such service unless good cause he shown for that dci`endant's l`ailure to sign and return the
waiver.
lt is not good cause lor a lailure to waive service that a party helievcs that the complaint is
unloundcd. or that the action has heen hrought in an improper place or in a court that laclts
_iurisdietion over the suhiect matter of the action or over delcndant`s person or property. ,\
dclendant who waives service ofsumnions retains all defenses and ohjeetions. excepz any
relating to the summons or the service of summons. and may later ohjcct to the_pa·i»aliction or me
(`ouri or to the place to where the action has heen brought.
A defendant who waives service must within the time specilied on the "Return of Waiver"
term served on plaintiff, ifunrepresented or on plaintiffs attorney. a response to the (`ompiaint
and must also tile a signed copy ofthe response with the Court. ifthe answer or a motion is not
served within this time. a default judgement may he taken against that deicndant. liv waiving
service. a delcndant is allowed more time to answer than ifthe summons had been actually
served when the request for waiver of service was received.
