San Diego, California (the "store") with the intention of purchasing a hot water heater for my residence. When I was at the store I saw and read Home Depot's two uniformed advertisements for water heaters and their installation posted in the store's aisle for water heaters. Relying on Home Depot's advertisements, and with the expectation that, if I paid for a hot water heater, delivery. installation. and a '.permit fee," I would indeed receive both the purchase, delivery and installation of a hot water heater, and any and all required permits relating to the installation of the hot water

Scope: This Agreement is between You and Home Depot. Under this Agreement, Home Depot does n o t perform Installation, b u t arranges for Professional t o do so directly or through Professional's specialty subcontractors. Professional, not Home Depot, is responsible for obtaining liability and workers' compensation insurance covering Professional's operations and Professional's employees related t o the Installation. Home Depot does not provide, or arrange for, architecturallengineering services or structural changes t o dwellings. You will not pay anything t o Professional, although Professional m a y present this Agreement t o You for Your review and signature and/or collect Your payment(s) t o Home Depot on Home Depot's behalf. lnstallation will, subject to any Change Order, be completed i n substantial conformance w i t h the attached lnvoice or Specifications. Failure t o substantially commence w o r k within t w e n t y (20) days f r o m the lnstallation date specified in this Agreement, without lawful excuse, is a violation of the contractor's License Law. Special Order and C u s t o m Made. Changes and Change Orders: Home Depct, at Your request, may arrange for Professional t o perform additional work, subject t o a Change Order and additional charges payable b y You t o H o m e Depot. You may n o t require H o m e Depot t o perform extra or change order w o r k w i t h o u t providing written authorization prior t o the commencement of any w o r k covered b y t h e n e w change order. A n y changes t o Instal!ation, i.e., a substitution of materials or an expansion of the scope of t h e work, will require You and Professional (on Home Depot's behalf) t o sign a Change Order t h a t will become part o f this Agreement. Change Orders shall be clear i n scope and specify any additional payment(s) andlor changes i n anticipated completion dates. However, Home Depot's failure t o comply w i t h these Change Order requirements does not preclude the recovery of compensation for w o r k performed based upon legal or equitable remedies designed t o prevent unjust enrichment. Home Depot m a y immediately ask for a Change Order, discontinue Installation, or terminate this Agreement w i t h o u t further obligation t o You; following discovery of previously undisclosed/ such unidentified legal encumbrances on Your premises, buildinglzoning code violations, or hidden!unforeseen physical or environmental i ~ a z a r d s as the presence of ijiideryrouna or overhead utility lines, rocks, roots, buried debris, mold, asbestos, lead paint, or any conditions differing f r o m w h a t You represented. Note about Extra Work and Change Orders: Extra Work and Change Orders become part of this Agreement once the order is prepared i n writing and signed b y the parties prior t o the commencement of any work covered b y t h e n e w change order. The order must describe the scope of the extra w o r k or change, the c o s t t o be added or subtracted from the contract, and t h e e-ffect the order will have o n t h e schedule of progress payments. Professional's Responsibilities: Professional will complete lnstallation i n a workmanlike manner.
