I write on behalf of the defendants (coilectively, "Defendants") in the above~—
referenced proceeding On March 2, 2005, Defendants filed their (1) Joint Motion to Disrniss for
Lack of Subject Matter Jurisdiction and their (2) Joint Motion to Dismiss for Failure to State at
Claim (collectively, the "Motions"). On. April IS, 2005, Plaintiff tiled its briefs in opposition to
the Motions and on June 3, 2005, Defendants filed their reply briefs in further support of their
Motions. Accordingly, the Motions are now fully briefed. Pursuant to District of Delaware
Local Rule 7.1.4, Defendants respectliilly request that oral argument be scheduled on the
