THE DEFENDANT MOVES that Metropolitan Correctional Center ("MCC"), and any hospital

18 or medical facility that treated Mr. De la Concha, to release all documents pertaining to Mr. De la Concha's 19 May 16, 2008 surgery and the related inguinal hernia condition. This includes, but is not limited to, all reports 20 and notes pertaining to Mr. De la Concha's hernia and the resulting surgery. 21

Defense counsel requested these documents from MCC, with a medical release form signed by

22 Mr. De la Concha. MCC responded that a court order was necessary for them to release the requested 23 documents. 24 25
