The Court issued an order that dismissal documents were to be submitted on or before July 22, 2008. Otherwise, a Settlement Disposition Conference would be held on July 23, 2008. [Doc. No. 8.] Dismissal documents were not filed, and as required, Plaintiff's counsel appeared telephonically for the Settlement Disposition Conference. However, Michael Palmer, attorney for Defendant La Mesa Auto Care, Inc., did not appear. As such, a hearing shall be held on August 14, 2008, at 1:30 p.m. in Courtroom E of the above-entitled court. Mr. Palmer shall appear in person and show cause why sanctions should not be imposed for failure to attend a court-ordered Settlement Disposition Conference on July 23, 2008, at 9:30 a.m. On or before August 7, 2008, Mr. Palmer shall file a declaration informing the Court why he did not attend the Settlement Disposition Conference and why sanctions should not be imposed for his failure to appear. In the declaration, Mr. Palmer shall also inform the Court of the status of the v. LA MESA AUTO CARE, INC.; JACOBSZOON REVOCABLE FAMILY TRUST dated 4/17/98; CULVER FAMILY REVOCABLE TRUST; JAREL G. settlement, which he represented to the Court had been reached. If dismissal documents are submitted on or before August 13, 2008, per the instructions laid out in the Court's June 3, 2008 Order [Doc. No. 8], the Order to Show Cause Hearing shall be vacated. IT IS SO ORDERED.
