Dear Judge Figa: I failed to appear at the scheduling conference set in the above-cited case on Tuesday, October 24, 2006, at 1:30 p.m. I apologize profusely for that failure. By way of explanation, but not justification, I left town on October 10, 2006. Someone else was checking my e-mail while I was gone and moved the notice of resetting of the conference into my internet (aol) account without noting the change on my calendar. While there were other ways I should have known about the change, I did not take them. As a result, I wasted your time, your clerk's time, and that of defendant's counsel. I feel horrible about that. I feel even worse because I had requested the rescheduling as I was going out of town. At the time of the hearing, I was in Greeley providing pro se advise to a client on a First Amendment issue. As to the substance of the scheduling conference, I agree with the list of issues and scheduling actions identified in the joint filing made by defendant and plaintiff for the conference, and ask that you set the schedule according to that filing. Again, please accept my apologies. I have called and personally apologized to Mr. Nachman. Sincerely,
