NOTICE OF DEPOSITION OF ADOBE SYSTEMS, INC. PLEASE TAKE NOTICE that, pursuant to Federal Rules of Civil Procedure 30(b)(6) and 45, Plaintiff Ampex Corporation ("Ampex"), by and through their attorneys, will take the deposition upon oral examination of Adobe Systems Inc. ("Adobe"), commencing at 9:00 a.m. on February 27, 2006, at the law offices of Ropes & Gray LLP, 525 University Avenue, Suite 300, Palo Alto, California 94301 on the topics identified in Exhibit A to the attached subpoena. The examination will be taken before a Notary Public or other person authorized to administer oaths and will continue from day to day until completed. You are invited to attend and cross examine. A subpoena is being served upon Adobe commanding it to attend the deposition and compelling it to produce for inspection and copying by February 27, 2006, documents identified in Exhibit A attached thereto.
