STIPULATION TO DISMISS CERTAIN DEFENDANTS, WITH PREJUDICE

Plaintiff, LINDA M. PIERCY; and Defendants TERRY MAKETA, AS SHERIFF OF EL PASO COUNTY SHERIFF'S OFFICE; EL PASO COUNTY SHERIFF'S OFFICE; and THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EL PASO hereby submit this stipulated motion for partial dismissal. As reasons therefor, the parties state as follows: 1. Plaintiff has agreed to the dismissal of Terry Maketa, as Sheriff of El Paso

County, and the El Paso County Sheriff's Office. 2. Following dismissal of these defendants, Plaintiff, Linda M. Piercy, and El

Paso County, by and through the El Paso County Board of County Commissioners, will enter into a settlement agreement to dismiss the balance of the claims.

WHEREFORE, the parties request dismissal, with prejudice, of Terry Maketa, as Sheriff of El Paso County Sheriff's Office, and the El Paso County Sheriff's Office as set out above, with each party to pay his or her own costs and fees, and that those defendants be removed from the court caption.
